An unmarried Pakistani woman lived with her father. Her sister living a few doors away gave birth to a daughter in 1999. The daughter was cared for by the unmarried woman and her father. The unmarried woman moved to UK and got a job. She visited Pakistan every year and spent continued to provide financial support for the child. When the child was 17 they applied for a visa for an adopted child. UK High Commission refused. They claimed that:1- Pakistan was not a signatory to the UN convention on adoption so Pakistani adoptions had to undergo all the hoops created by the de facto adoption provisions of the Immigration Rules. 2. The child was still in regular relationship with the natural parents.
One of the requirements was that the adopter goes to reside with the child for 12 months before the application. We demonstrated that the UN convention was signed by only Malaysia and one other Muslim state and to require a person to give up their job and go to live in Pakistan was perverse. The Adjudicator at Birmingham agreed with us.The child was given the visa and now resides in UK as a British Citizen.
A girl born to a man who had become British before the birth had been left with her grandmother in Pakistan. She never knew she was British. The parents had made false declarations about the number of children to the UK authoritie . She was not included. She was living in a village. The parents died. Lawyers in Pakistan advised her to get a forged marriage certificate for her parents and claim UK nationality. The forgery was caught by the UK High Commission in Islamabad .They kept rejecting her UK passport application over a period of ten years. We were instructed and she received her UK passport and is now living in UK.
